How to build a house?

When you build your own house you are able to realize your idea of how it should ideally be. As your house grows brick by brick, your house will grow, you will experience the joy of your work and effort delivering results. The construction of an individual residential building means that you have to comply with the following construction procedures:

Requesting an architectural and planning assignment and technical specifications

You may receive an architectural and planning assignment and technical specifications:

1. At egov.kz portal.

For this purpose you need to do the following:

  1. obtain EDS (an electronic digital signature);
  2. log in and request source materials/architectural and planning assignment and technical specifications;
  3. attach the following to your application:
  • electronic copy of the deed of title to the land plot or a local authority’s reconstruction (re-planning, reconfiguration) permit;
  • electronic copy of a design specification;
  • electronic copy of a survey on technical specifications for utility connections;

In order to receive source documents:

  • application for source materials/architectural and planning assignment and technical specifications;
  • electronic copy of the deed of title to your land lot or the Architecture and Urban Planning Department’s reconstruction (re-planning, reconfiguration) permit;
  • electronic copy of an approved design specification;
  • electronic copy of a survey on technical specifications for utility connections;
  • electronic copy of your land’s topography.

Note: in order to obtain records on ID, a legal entity’s state registration (re-registration), registration as an individual entrepreneur, a certificate of registered rights (encumbrances) to real estate and technical parameters thereof, a service provider and an employee of the State Corporation rely on relevant state info-systems via e-Government gateway.

Turnaround time: 6 working days. 15 working days to receive the source documents (architectural and planning assignment, technical specifications, an extract from the town plan, vertical grade elevations, transverse profiles of roads and streets, external utilities grid diagram).

15 working days for review of the request for design of technically and/or process complicated facilities. 17 business days to receive the source documents (architectural and planning assignment, technical specifications, an extract from the town plan, vertical grade elevations, transverse profiles of roads and streets, external utilities grid diagram).

The end result of the service: an architectural and planning assignment with the source documents attached:

  1. technical specifications;
  2. external utilities grid diagrams;
  3. extract from the town plan;
  4. vertical grade elevations;
  5. transverse profiles of roads and streets.

2. Receiving the service through the district department of the State Corporation “Government for Citizens” of Almaty at your place of registration.

For this purpose you need to provide:

  1. application for source materials/architectural and planning assignment and technical specifications;
  2. your document of identification;
  3. approved design specification;
  4. deed of title to the land lot, which is to reflect such land’s purpose - private housing project – or a certificate of state registration of entitlement to real estate and transactions therewith (owner’s records);
  5. an electronic copy of a survey on technical specifications for utility connections.

In order to request source documents, you need:

  1. application for source materials/architectural and planning assignment and technical specifications;
  2. your document of identification;
  3. approved design specification;
  4. the deed of title to your land plot or the Architecture and Urban Planning Department’s reconstruction (re-planning, reconfiguration) permit;
  5. survey on technical specifications for utility connections;
  6. topography.

Turnaround time: 6 working days. 15 working days to receive the source documents (architectural and planning assignment, technical specifications, an extract from the town plan, vertical grade elevations, transverse profiles of roads and streets, external utilities grid diagram).

15 working days for review of the request for design of technically and/or process complicated facilities. 17 working days to receive the source documents (architectural and planning assignment, technical specifications, an extract from the town plan, vertical grade elevations, transverse profiles of roads and streets, external utilities grid diagram).

The end result of the service: an architectural and planning assignment with the source documents attached:

  1. technical specifications;
  2. external utilities grid diagrams;
  3. extract from the town plan;
  4. vertical grade elevations;
  5. transverse profiles of roads and streets.

3. Via the District-based Architecture and Urban Planning Department of Almaty at the place of registration of your land lot.

For this purpose you need to provide:

  1. application for source materials/architectural and planning assignment and technical specifications;
  2. your document of identification;
  3. copy of an approved design specification;
  4. copy of your deed of title to the land lot, which is to reflect such land’s purpose - private housing project – or a certificate of state registration of entitlement to real estate and transactions therewith (owner’s records);
  5. survey on technical specifications for utility connections.

In order to request source documents you need:

  1. application for source materials/architectural and planning assignment and technical specifications;
  2. your document of identification;
  3. copy of an approved design specification;
  4. copy of your deed of title to your land plot or the Architecture and Urban Planning Department’s reconstruction (re-planning, reconfiguration) permit;
  5. survey on technical specifications for utility connections;
  6. topography.

Turnaround time: 6 working days. 15 working days to receive the source documents (architectural and planning assignment, technical specifications, an extract from the town plan, vertical grade elevations, transverse profiles of roads and streets, external utilities grid diagram).

15 working days for review of the request for design of technically and/or process complicated facilities. 17 working days to receive the source documents (architectural and planning assignment, technical specifications, an extract from the town plan, vertical grade elevations, transverse profiles of roads and streets, external utilities grid diagram).

The end result of the service: an architectural and planning assignment with the source documents attached:

  1. technical specifications;
  2. external utilities grid diagrams;
  3. extract from the town plan;
  4. vertical grade elevations;
  5. transverse profiles of roads and streets.

Design and approval of a conceptual design

A conceptual design must be approved at the district-based Architecture and Urban Planning Department of Almaty at the place of registration of your land lot.

For this purpose you need to provide:

  1. application in a required format;
  2. your document of identification (necessary to verify a service recipient’s identity);
  3. conceptual design;
  4. copy of an architectural and planning assignment.

Turnaround time: not more than 10 working days to review the conceptual design of technically simple buildings; not more than 15 working days to review the conceptual design of technically and process complicated buildings. Not more than 5 working days in case of a reasoned denial.

The end result of the service: approval on a conceptual design, or a reasoned answer on denial to the public service.

House construction process

Before you begin building a house, you need to enter into a general contractor agreement with a construction company and a technical supervision agreement with a licensed company.

You have a year to build it.

Important to know!

  1. As noted in Article 3 of the Law of the Republic of Kazakhstan "On Individual Housing Construction", you may build a house both on your own and with contractor resources for any project that does not violate the conditions of safe habitation and meets the state standards and regulations that are set by an architectural and planning assignment.
  2. You cannot start building a house based on the design that does not include the architectural and planning assignment’s and technical specifications’ terms. Such house will be deemed illegal and its owner will be penalized!

Acceptance into service

At the completion of construction and installation works, after you receive a written notice of completion from your contractor (if you have engaged a contractor), you need to start the procedure of commissioning. The Law "On architectural, town-planning and construction activities" became effective on January 1, 2001, which has abolished the need to involve a commission in accepting a building into service. According to Article 74 of the Law of the Republic of Kazakhstan "On architectural, town-planning and construction activities in the Republic of Kazakhstan", you, as an owner of housing, may independently commission a completed technically simple building.

Acceptance certificates are to be signed by:

  1. client (which is you);
  2. contractor (a construction team);
  3. authorship supervision (a company that delivered designing estimates);
  4. technical supervision (a company contracted to provide technical supervision).

In total, four certificates of acceptance have to be signed. This means that all the specified participants of the process bear administrative and criminal responsibility for risk to the life or health of citizens that can be caused by the violation of construction norms.

After you complete the construction, you will be provided with:

  1. a statement of compliance of the completed construction and installation works with the approved design – to be issued by your contractor;
  2. a report of proper and high-quality delivery of construction and installation works - to be issued by technical supervision (a company contracted to provide technical supervision);
  3. a statement of compliance of the completed construction and installation works with the approved design projects – to be issued by authorship supervision (a company that delivered designing estimates).

A procedure for independent commissioning of simple buildings consists of the following milestones:

  1. you accept a technically simple building into service by signing a certificate of standalone acceptance;
  2. you make sure that the requirements of the design estimates or a conceptual design, source documents for designing a building and existing regulations are met;
  3. you make sure that the construction and installation works delivered, construction materials (products, structures) used and the equipment involved comply with the design estimates or a conceptual design as well as with national/international guidelines, if you engaged a construction contractor.

A date of signing the acceptance certificate shall be the date of owner’s direct commissioning.

Then you must have your acceptance certificate signed at the district-based Architecture and Urban Planning Department of Almaty.

For this purpose you need to provide the following documents:

  1. approval from the Almaty Department of State Architectural and Construction Control on construction and installation works;
  2. other authorities’ authorizations (utilities, seismologic, environmental monitoring) depending on a situation (issued by Gosexpertiza RSE);
  3. architectural and planning assignment, and technical specifications issued by the mayor’s office and municipal services;
  4. design estimates (conceptual design);
  5. certificates of acceptance (in four copies).

The end result of the service: based on a signed certificate of acceptance (with an acceptance date to be indicated), you are provided with identification documents on your real estate and a state registration of title to real estate.

Receiving a technical passport

After you are done with construction, you will need to legalize your building and your entitlement to it by requesting a technical passport.

In order to get a technical passport for your house, you will need to file a request:

1. At egov.kz portal.

For this purpose you need to:

  1. obtain EDS (an electronic digital signature);
  2. log in and send a request;
  3. support your request with electronic copies of your deed of title to the building, an existing technical passport, if available, and/or an identification document on your land lot;
  4. formal proof of payment of state duty for a technical passport (at limited service branch offices of any second-tier bank or at Kazpost offices);
  5. in your personal account, read the notification about your request being processed.

A state duty is paid in two stages - when you submit an application and when you receive a technical passport. When you receive your house’s technical passport, you must fully pay/additionally pay for the state technical survey of your property in accordance with the Price List.

You may pay the state duty for the public service in an electronic form with your bank card or by providing your current account, in accordance with the Price List that you can find at www.adilet.gov.kz, in Public Services section.

In case of electronic payment you will be charged a fee of 100 tenge.

When you receive your house’s technical passport, you must fully pay/additionally pay for the state technical survey of your property in accordance with the Price List.

Turnaround time: to be reflected in your personal account.

The end result of the service: you will get a notification that your technical passport is ready; you will be provided with the place and date on which you can pick up your technical passport from the State Corporation “Government for Citizens” in Almaty.

On a fixed date you need to visit the State Corporation “Government for Citizens” of Almaty to pick up your technical passport for your house.

2. At a district-based office of the State Corporation “Government for Citizens” in Almaty at the place of your registration.

For this purpose you need to provide the following:

  1. application for the technical passport;
  2. your document of identification;
  3. your deed of title to the building with an existing technical passport, if available, and/or entitlement to your land lot;
  4. formal proof of payment of the state duty for the service in accordance with the Price List that you can find at www.adilet.gov.kz, in Public Services section.

A state duty is paid in two stages - when you submit an application and when you receive a technical passport. When you receive your house’s technical passport, you must fully pay/additionally pay for the state technical survey of your property in accordance with the Price List.

Turnaround time: technical passports for apartments and rooms in community buildings/dorms are issued on the third business day. Technical passports for individual houses, individual garages, and country buildings are issued on the fifth business day.

The end result of the service: you get a technical passport for your property.

Registering your certificate of acceptance and making changes to its identification parameters

A final stage of the whole procedure is to have your certificate of acceptance registered and its identification parameters altered; to seek registration, please contact:

1. A district-based office of the State Corporation “Government for Citizens” in Almaty at the place of your registration.

For this purpose you need to provide the following:

If you are an individual:

  1. application for the state registration of title (title encumbrance) to real estate;
  2. your document of identification;
  3. title certificate confirming the object of registration;
  4. formal proof of payment of a registration fee or a record acknowledging a separate category of benefits and providing an exemption from fee collections.

If you are a legal entity:

  1. application for the state registration of title (title encumbrance) to real estate;
  2. title certificate confirming the object of registration;
  3. formal proof of payment of a registration fee or a record acknowledging a separate category of benefits and providing an exemption from fee collections;
  4. founding documents;
  5. minutes of the meetings (excerpts thereof) of founders (participants, board of directors, shareholders’ board) on purchasing or selling items of real estate in cases provided for by the Laws "On Joint Stock Companies" and "On State-owned Property" or founding documents;
  6. foreign companies submit a legalized extract from the trade register or another legalized document certifying that such foreign legal entity is a legal entity under the legislation of a foreign country with a notarized translation into the state and Russian languages.

Note:

  1. If a registration application contains information that the cumulative book value of the assets being purchased or sold exceeds the amounts established by the antitrust legislation of the Republic of Kazakhstan, a service recipient shall submit an antitrust authority’s preliminary consent.
  2. Documents confirming the origin, change and termination of title to real estate, and other objects of state registration shall be submitted in two copies, one of which is to be an original or a notarized copy.

Turnaround time: within three business days from the date the service provider receives the request. If you decide to have your real estate registered in the accelerated manner, you get your registration on the next business day from the moment your request is received by the State Corporation “Government for Citizens” (CSC).

The end result of the service: a title deed with a note on the state registration of title (title encumbrance) to real estate or suspension of registration, or a written reasoned response on denial to the public service.

2. A public notary (if you are electronically applying for registration at egov.kz).

For this purpose you need to:

  1. file a request certified by a notary’s EDS;
  2. provide documents:
  • service recipient’s document of identification (an original document for identification);
  • title deeds acknowledging a registration object certified by a public notary (to be attached by a public notary electronically to the request);
  • payment of a registration fee to the budget or a record acknowledging a separate category of benefits and providing an exemption from fee collections for the following categories: the retired living on their own and small businesses engaged in training of personnel for the past three years since state registration (to be attached in an electronic form to the request);
  • e-mails of transaction parties (if any).

Turnaround time: within three working days from the date the service provider receives the request. If you decide to have your real estate registered in an accelerated manner, you get your registration on the next business day from the moment your request is received by the State Corporation “Government for Citizens” (CSC).

The end result of the service: you will be sent a notification of registration or suspension of registration or a written reasoned response on denial the public service.
