How to obtain a land parcel?

If you are a citizen of Kazakhstan Republic or a repatriate (an ethnic Kazakh who has returned to his motherland from abroad), you have a legitimate right to get a 0,10 hectares land parcel for individual housing construction (IHC) irrespective of the real estate ownership.

At the present time there are no available land facilities for IHC in Almaty, but a citizen/repatriate has an opportunity to apply to Akimat of Almaty region to obtain a land parcel within the limits of the region.

A land parcel granting

You can obtain a land parcel by means of:

1. Web portal egov.kz.

1 STAGE

You need to:

  1. submit a duly issued application;
  2. attach an e-copy of the land parcel location chart.

Within three working days you need to get an agreement on the irrevocable land allocation certificate and pay bills for land cadastral works.

You can pay bills for a land cadastral map of the land parcel in cash or through the second-tier banks on the transaction account of the State Corporation “Government for Citizens” division of Almaty or at the cash desks of the State Corporation “Government for Citizens” division of Almaty, where you can get a billing document (pay receipt) confirming the date and amount of payment.

Period of validity of the unagreed land allocation certificate is ten working days. If the period is expired the State Corporation “Government for Citizens” of Almaty is to return the unagreed certificate for withdrawal to the Department of Architecture and Urban Development of Almaty, notifying you in advance.

Turnaround time: 28 working days.

The intermediate result of the service: preparation of the land allocation certificate with the affirmative statement of the approving authorities.

2 STAGE

You need to apply for registration of the land leasehold (allocative decision for the land use right attaching the land cadastral map and the temporary (short-term/long-term) gratuitous (paid) land use agreement).

You need to attach the following documents to your e-request:

  1. an agreed irrevocable land allocation certificate;
  2. billing document for land cadastral works.

When you receive a notification message in your “private account” you need to sign a temporary land use agreement within three working days.

The period of validity of the unsigned land use agreement is seven working days.

The signed temporary land use agreement should be officially registered and delivered to you via the regional department of the State Corporation “Government for Citizens” of Almaty according to the place of registration.

The service provider and the worker of the State Corporation receive the information about identification documents/corporation and reincorporation from the corresponding governmental information systems via egov.kz web portal.

Turnaround time: 22 working days. Refusal of the application processing due to the incomplete set of documents – 2 working days.

The end result of the service: allocative decision for the land use right attaching the land cadastral map and the temporary (short-term/long-term) gratuitous (paid) land use agreement, or substantiated refusal.

2. Regional department of the State Corporation “Government for Citizens” of Almaty according to the place of registration.

1 STAGE

You need to submit the following documents:

  1. duly issued application;
  2. land parcel location chart;
  3. document of identification.

Within three working days you will get an agreement on the irrevocable land allocation certificate and pay bills for land cadastral works. You can pay bills for a land cadastral map of the land parcel in cash or through the second-tier banks on the transaction account of the State Corporation “Government for Citizens” of Almaty or at the cash desks of the State Corporation “Government for Citizens” of Almaty, where you can get a billing document (pay receipt) confirming the date and amount of payment.

Period of validity of the unagreed land allocation certificate is ten working days. Real estate title registration

1. Via egov.kz web portal (if applied to the notary public).

  1. File a request certified by the notary’s EDS.
  2. Attach the following documents: document of identification of the real estate owner; entitling documents certified by the notary (attached to the e-request by the notary); the state duty pay receipt for the real estate registration or the document verifying the separate category of privileges and granting the exemption from duties (the privileges are available for resident pensioners and small business entities which are involved in staff training and instruction within three years from the moment of the state registration).
  3. Point out the e-mails of the parties to the contract (if available).

Note: the State Corporation employee and the notary receive the data (information about the document of identification; corporation and reincorporation; participants of the World War II and persons equaled to them; persons awarded with the former USSR decorations and medals for selfless labor and honorable service in the rear during World War II; persons who had worked (served in the army) for at least six months from June 22, 1941 through May 9, 1945 and had not been awarded with the former USSR decorations and medals for selfless labor and honorable service in the rear during World War II; disabled persons, including one of the parents of a lifelong disabled person; orphaned children and children without parental support until they are 18; repatriates) from the corresponding governmental information systems via egov.kz web portal.

Turnaround time: 3 working days. Applications for urgency – the next working day from the moment the application is rendered to the State Corporation “Government for Citizens” of Almaty.

The end result of the service: notification of registration or suspension of registration, or written motivated refusal of the state service delivery.

2. Via regional department of the State Corporation “Government for Citizens” of Almaty according to the place of registration.

If you are an individual, you need to submit the following documents:

  1. duly issued application form for the state registration of the real estate rights and encumbrances;
  2. document of identification;
  3. document of identification for the land parcel;
  4. the state duty pay receipt for the real estate registration or the document verifying the separate category of privileges and granting the exemption from duties (the privileges are available for resident pensioners and small business entities which are involved in staff training and instruction within three years from the moment of the state registration).

Turnaround time: 3 working days. Applications for urgency – the next working day from the moment the application is rendered to the State Corporation “Government for Citizens” of Almaty.

The end result of the service: the title document with the note of the state registration of the real estate rights (encumbrances) or suspension of registration, or written motivated refusal of the state service delivery.

If you are a legal entity, you need to submit the following documents:

  1. duly issued application form for the state registration of the real estate rights (encumbrances);
  2. title document verifying the object of registration. Upon the registration of rights (encumbrances) for a land parcel, you should submit the identification document of the land parcel. Upon the cession of rights (claims) under the mortgage contract you shall submit the assets and liabilities assignment contract;
  3. the state duty pay receipt for the real estate registration or the document verifying the separate category of privileges and granting the exemption from duties (the privileges are available for resident pensioners and small business entities which are involved in staff training and instruction within three years from the moment of the state registration);
  4. constituent documents;
  5. minutes of the meetings (extracts from them) of the founding parties (members, executive board, shareholder’s council) regarding the acquisition or alienation of the real estate;
  6. foreign legal entities should submit a legalized abstract of the trade register or another legalized document confirming that a foreign legal entity is a legal entity under the law of the foreign country attaching the translation to the state and Russian languages certified by a notary.

Important!

  1. If the application form provides the information that the aggregate balance value of the assets to acquire or to sell exceeds the amount stipulated by the antitrust legislation of Kazakhstan Republic, it is necessary to submit an auxiliary prior consent of the antitrust agency.
  2. The documents verifying the emergence, changes and termination of the rights for the real estate and other facilities that are subject to the state registration, should be submitted in a set of two, one of which is an original or a notary certified copy.
  3. If the certificate of title is a court ruling, or if the original document cannot be surrendered to the titleholder, the titleholder should submit two certified copies of the document for registration.
  4. If the premarital agreement is available, it is should be submitted in a set of two, one of which is an original or a notary certified copy.
  5. To register the rights of the other spouse which is not included in the certificate of title, a marriageable applicant is to put on the form the information of being not in a marriage or the information about his spouse attaching the copy of the document verifying the marital relationships.

Turnaround time: 3 working days. Applications for urgency – the next working day from the moment the application is rendered to the State Corporation “Government for Citizens” of Almaty.

The end result of the service: the title document with the note of the state registration of the real estate rights (encumbrances) or suspension of registration, or written motivated refusal of the state service delivery.

To put the residential in commission and obtain the private ownership of the land parcel

Within 6 months from the moment of issuance of the land use entitlement, it is necessary to put the residential in commission, i.e. to accept the individual household as commissioned and fully operational. Only if this item of the contract is adhered, the land parcel could be privatized.

If the household is not built within six months, a person should apply to the akimat according to the place of the land parcel location and to prolong the lease period for six more months.

If the household is not built and commissioned within two years, the state has a right to seize the land with a claim for indemnification according to the article 93 of the Land Code of Kazakhstan Republic.
