I want to adopt a child

Congratulations on such an important decision as the adoption of a child! Child adoption is a serious and deliberate step that implies a high degree of an adopter’s responsibility for the fate of a foster child. If you decide to adopt a child, you need to know that a prospective adopter is entitled to request comprehensive legal, psychological and pedagogical assistance from the beginning to the end of the adoption procedure.

You need to know! Adoption is a priority form of placing a child into the family, which legally establishes family ties between a child and a person or a married couple that are not his/her real parents. All rights and duties of an adopted child are equal to the rights and duties of children of your own!

*If you are to adopt a child older than 10 years, you will need his or her consent! "Kazakhstan Without Orphans" project of the Committee for the Protection of Children's Rights of the Republic of Kazakhstan and the "Mercy" Foundation as supported by "Samruk Kazyna" Fund JSC enables those wishing to adopt a child to access the nationwide database of orphans and children left without parental care -http://www.usynovite.kz/. The database offers you video interviews of children in need of families. Maybe here you will find a child who could become your own.

Who can become an adopter?

According to the adoption procedure, a single woman, a married couple, physically and mentally healthy people, people with a stable income and housing may adopt a child. As an exception, if you are a man who actually brings up a child who became an orphan or left without parental care, you are also entitled to adoption.

For complete information on the possibilities and ways of this procedure, please contact the district custody and guardianship unit of the Almaty Education Department at the place of your registration.

How to become registered with the Education Department as a prospective adopter?

To do this, you will need to register yourself with the Education Department of Almaty as a prospective adopter and provide:

  1. request for adoption;
  2. a service recipient’s ID (required to identify a person);
  3. written consent of close relatives for a child’s adoption;
  4. statement of aggregate income (pay statement from the place of employment, proof of income from entrepreneurial activities and other incomes of all cohabiting family members). *According to the marriage and family laws of the Republic of Kazakhstan, parents and children are considered family members;
  5. statement of family status (a copy of the statement of divorce/marriage if marriage/divorce took place before 2008, copies of children’s birth certificates if children were born before August 13, 2007, or outside the Republic of Kazakhstan (if children are available);
  6. health certificate (086-u form) issued by the polyclinic at the place of attachment as well as certificate of mental health issued by the Center for Mental Health in Almaty and formal proof that you don’t have drug (toxic) and alcohol addiction issued by the Center for Medical and Social Correction of Almaty.

Along with the copies, you present original for purposes of reconciliation, and then you get them back.

Turnaround time: 15 calendar days.

Outcome of the service delivery: you get a notification about whether you may or may not be a prospective adopter.

Have yourself registered as a prospective adopter at egov.kz

To do this, you will need to:

  1. receive EDS (electronic digital signature);
  2. log in and file a request;
  3. attach the following:
  • an electronic copy of the written consent of close relatives for the adoption of the child;
  • an electronic copy of statement of aggregate income (pay statement from the place of employment, proof of income from entrepreneurial activities and other incomes of all cohabiting family members);
  • an electronic copy of statement of family status (a copy of the statement of divorce/marriage if marriage/divorce took place before 2008, copies of children’s birth certificates if children were born before August 13, 2007, or outside the Republic of Kazakhstan (if children are available);
  • an electronic copy of health certificate (086-u form) issued by the polyclinic at the place of attachment as well as certificate of mental health issued by the Center for Mental Health in Almaty and formal proof that you don’t have drug (toxic) and alcohol addiction issued by the Center for Medical and Social Correction of Almaty.

Note. It is not required to attach copies of a service beneficiary’s ID, title to housing or entitlement to use housing, and copies of statements from the Legal Statistics Committee and General Prosecutor’s Office on whether a service beneficiary has committed any crime. These records are obtained by the service provider from governmental information systems through the "e-government" gateway.

Turnaround time: 15 calendar days.

Outcome of the service delivery: you get a notification about whether you may or may not be a prospective adopter.

Getting a referral to an orphanage to select a child

If your candidacy is approved, you need to receive a referral with which you will be able to access an orphanage in order to choose a child.

The district guardianship and custody office of the Education Department of Almaty will issue a referral once you submit the abovementioned documents and your candidacy is approved.

You are entitled to at least two weeks to get to know a child and study his/her personal records. At the end of this period, you will need to confirm in writing that you are aware of the child's health status as well as confirm whether you refuse or further participate in the adoption procedure.

Attending the school of foster parents

If you intend to continue the adoption procedure, you will need to attend the school of foster parents.

At a school of foster parents you can learn about the nature of raising foster children and how to prepare mentally and practically for a new child at your home.

You should know that those wishing to adopt orphans, children left without parental care under the age of one year have the right to take a child under guardianship or patronage before the adoption procedure is completed.

Provisional outcome of the service delivery: you get a referral to the orphanage.

Contacting the Specialized Inter-District Juvenile Court of Almaty with an adoption request

When you contact the Specialized Inter-District Juvenile Court in Almaty, you must provide all available documents as well as permission from the district guardianship and custody office of the Education Department of Almaty authorizing the transfer of a child for adoption.

When the adoption request is satisfied, the court’s decision is sent to the Civil Registration Office at the location of the court for the state registration of the child's adoption as well as to the district guardianship and custody office of the Education Department of Almaty at the place of registration of the prospective adopters. It is the court that shall decide to change the personal details of the child (his/her last name, first name, date and place of birth).

Note. First name, patronymic and last name of an adopted child who reached the age of ten may be changed only with his/her consent, except when adoption has to be kept secret.

Outcome of the service delivery: you get a court’s decision on adoption.

How to get an adoption certificate and a birth certificate?

You may receive an adoption certificate and a birth certificate at a district unit of the Civil Registration Office of Almaty at your own location.

In order to do this, please submit the following documents:

  1. request for registration of adoption;
  2. ID of one of the parents (for identification);
  3. copy of the court decision on adoption;
  4. child’s birth certificate;
  5. a copy of the marriage certificate of the adopters (except when they married after 2008 in the territory of the Republic of Kazakhstan);
  6. notarized power of attorney, in case where a request is filed by the representative of the service beneficiary.

Foreign adopters living in Kazakhstan additionally provide:

  1. a foreigner’s residence permit;
  2. ID with a certified translation to state or Russian language;
  3. proof of payment of a state duty (only foreign adopters have to pay the state duty).

Turnaround time: 1 business day. Amendments, additions and adjustment to the record of entry - 15 calendar days. If a request is filed with other authorities - up to 30 calendar days.

Outcome of the service delivery: you get an adoption certificate and a birth certificate.

Your rights and obligations post-adoption

You need to submit a written report to the custody and guardianship unit of the Education Department of Almaty about the conditions of living, teaching, upbringing and health of the child at least once a year until the child reaches the age of 18 at the location at which the court decides on the child adoption. The report does not have a strict form and is descriptive. Attach photos of a child from an ordinary life. You should also be ready for inspections by the custody and guardianship authorities, which will be conducted regularly.

You are entitled to:

  1. if you have adopted a newborn child, you are entitled to child birth and child care benefits until it reaches one year. * Child care allowance may be provided if you are not a participant of the compulsory social insurance system;
  2. if you have adopted a child with disabilities, you are entitled to receive allowance for raising a disabled child.

To apply for a benefit, you may file an application in the prescribed form with the district office of the "Government for Citizens" State Corporation of Almaty at the location of your registration.

To do this, you will need to submit the following documents:

  1. a service beneficiary’s ID (identity card of a citizen of the Republic of Kazakhstan; residence permit of a foreigner permanently residing in the Republic of Kazakhstan) (required for identification), and for oralmans this will be an oralman’s identity certificate;
  2. a child’s (children’s) birth certificate (certificates) or an excerpt from the birth entry;
  3. proof of registration of a service beneficiary and a disabled child at the location of permanent residence;
  4. child’s disability certificate;
  5. proof of a bank account (bank’s statement of your 2-digit account);
  6. proof of adoption (adoption certificate);
  7. certificate of marriage/divorce (if details about a service beneficiary differ from details in a child’s birth certificate).

Turnaround time: 7 business days. If you are required to supply more records, this period may be extended to 30 business days.

Outcome of the service delivery: notification of an allowance being assigned to you (text message).

Child benefit for low-income families

If an average per capita income of your family is lower than the value of a food basket (equal to 60% of the subsistence level (22 859 tenge for 2016)), you are entitled to child allowance for children under 18 (1 MCI per child), for families with low income.

Pursuant to Article 9 of the Law of the Republic of Kazakhstan "On State Benefits for Families with Children", child allowance is assigned to the current quarter, based on a per capita income of a family and is paid monthly from the month of being requested.

The compensation is assigned:

1. through a district office of the "Government for Citizens" State Corporation of Almaty at the location of your registration. To do this, you will need to submit the following documents:

  • application in a designated form;
  • a child’s (children’s) birth certificate (certificates) or an excerpt from the birth entry;
  • your ID (foreigners submit a residence permit and oralmans submit an oralman’s identity certificate);
  • proof of residence for all family members (according to the marriage and family laws of the Republic of Kazakhstan, parents and children are considered family members);
  • records of a family composition (based on copies of identity documents and birth certificates, you fill out the form on family composition issued by the state authority);
  • statement of family members’ income (an applicant’s and family members’ pay statement from the place of employment);
  • certificate of marriage/divorce, if details about a service beneficiary differ from details in a child’s birth certificate;
  • proof of custody (guardianship) over a child or adoption (if you have adopted a child or took custody of a child).

Turnaround time: 7 business days.

Outcome of the service delivery: notification of allowance being granted for children under 18 or a reasoned denial in the service.

2. at the district office of the Employment and Social Programs Department of Almaty at your place of registration. To do this, you will need to submit the following documents:

  • application in a designated form;
  • a child’s (children’s) birth certificate (certificates) or an excerpt from the birth entry;
  • an applicant’s ID (identity card of a citizen of the Republic of Kazakhstan; residence permit of a foreigner permanently residing in the Republic of Kazakhstan - required for identification), and for oralmans this will be an oralman’s identity certificate;
  • proof of residence for all family members (according to the marriage and family laws of the Republic of Kazakhstan, parents and children are considered family members);
  • records of a family composition (based on copies of identity documents and birth certificates, you fill out the form on family composition issued by the state authority);
  • statement of family members’ income (an applicant’s and family members’ pay statement from the place of employment, including details on whether any subsistence farm is owned by them);
  • certificate of marriage/divorce, if details about a service beneficiary differ from details in a child’s birth certificate;
  • proof of custody (guardianship) over a child or adoption (if you have adopted a child or took custody of a child).

Note. There is no need to submit a service beneficiary’s ID, child’s (children’s) birth certificate or an excerpt from the birth entry (for registrations made in the Republic of Kazakhstan after August 13, 2007), marriage certificate (for registrations made in the Republic of Kazakhstan after June 1, 2008), proof of registration at the permanent place of residence, proof of adoption/custody over a child, when all the information contained in the said documents is verified by the governmental information systems.

Turnaround time: 7 business days.

Outcome of the service delivery: notification of allowance being granted for children under 18 or a reasoned denial in the service.

Lump-sum monetary benefit related to adoption

As an adopter, you are entitled to a one-time monetary allowance due to adopting an orphan and/or a child left without parental care. You may apply for the benefit via:

1. www.egov.kz. In order to do this, you will need to:

  • receive EDS;
  • file an EDS-certified request;
  • attach the following electronic copies of the documents:

- court’s decision on adoption having entered into force;

- a copy of the contract on opening a personal account in the name of one of the adoptive parents in a second-tier bank or in an organization licensed by the National Bank of the Republic of Kazakhstan to engage in certain types of banking operations.

You don’t have to attach the copies of the following documents:

  1. your ID;
  2. statements from the Legal Statistics Committee and General Prosecutor’s Office on whether a service beneficiary has committed any crime, including a spouse.

These records are obtained by the service provider from governmental information systems through the "e-government" gateway.

Turnaround time: 10 business days.

Outcome of the service delivery: decision on the assignment of a lump sum benefit in connection with the adoption of an orphan and/or a child left without parental care in the form of an electronic document signed by EDS of the service provider’s authorized person.

2. to the Education Department of Almaty. To do this, you will need to submit the following documents:

  • application;
  • court’s decision on adoption having entered into force;
  • copy of your ID;
  • copy of the contract on opening a personal account in the name of one of the adoptive parents in a second-tier bank or in an organization licensed by the National Bank of the Republic of Kazakhstan to engage in certain types of banking operations.

Turnaround time: 10 business days.

Outcome of the service delivery: decision on the assignment of a lump sum benefit in connection with the adoption of an orphan and/or a child left without parental care.

Note. Parents, relatives, officials of the guardianship and custody office, state authorities responsible for registration of adoptions, judges responsible for adoption decisions as well as other persons otherwise aware of adoption are required to keep adoptions secret. In case of violation of this, they may be prosecuted.
